1. Introduction

Pencco, Inc. (“Pencco,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information of visitors to our website located at www.pencco.com (the “Site”) and individuals who otherwise interact with us, including customers, prospective customers, vendors, and job applicants. This Privacy Policy explains what personal information we collect, how we use and share it, and the rights available to California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”).

This Policy applies to personal information we collect through the Site, through forms submitted to us, through phone and email correspondence, and through our LinkedIn page and other business communications. It does not apply to information we collect from our employees in their capacity as employees, which is addressed in a separate notice provided to personnel.

2. Personal Information We Collect

Pencco is a business-to-business supplier of water and wastewater treatment chemicals. We collect limited categories of personal information, primarily from individuals who contact us on behalf of their organization. In the preceding twelve (12) months, we have collected the following categories of personal information, as defined by the CCPA:

Identifiers

Name, business email address, business mailing address, phone number, job title, employer or company name, and IP address.

Commercial Information

Records of products or services requested, quote requests, order history, and communications regarding purchases or account inquiries.

Internet or Other Electronic Network Activity Information

Information regarding your interaction with the Site, including browser type, device information, pages visited, referring URLs, and information collected through cookies and similar tracking technologies (see Section 6, “Cookies and Tracking Technologies,” below).

Professional or Employment-Related Information

If you apply for a position with Pencco, we may collect your resume, employment history, education, references, and related application materials through our careers page.

Audio, Electronic, or Other Sensory Information

If you contact us by phone, calls may be recorded or monitored for quality assurance and training purposes, where permitted by law and disclosed at the time of the call.

Pencco does not knowingly collect Social Security numbers, financial account information, government identification numbers, precise geolocation, biometric information, or other categories of “sensitive personal information” as defined by the CCPA through the Site, except as may be provided voluntarily by job applicants during the hiring process.

3. Sources of Personal Information

We collect personal information from the following sources:

Directly from you, when you submit a form on the Site (for example, a request for quote, request for safety data sheets, order inquiry, or general contact form), call or email us, or apply for a job.
Automatically, through your use of the Site, via cookies, web server logs, and similar technologies.
From third parties, such as your employer, business associates who refer you to us, or publicly available professional networking platforms (such as LinkedIn).
From service providers who assist us in operating the Site or delivering our services.

4. How We Use Personal Information

Pencco does not sell personal information to third parties for monetary consideration. Depending on how our website analytics and advertising cookies are configured, the sharing of identifiers or internet activity information with analytics or advertising providers may be considered a “sale” or “share” of personal information under the CCPA’s broad definitions. To the extent this occurs, you may opt out as described in Section 7 below.

6. Cookies and Tracking Technologies

The Site may use cookies, web beacons, and similar technologies to operate the Site, remember preferences, and understand how visitors use the Site, including through web analytics services. You can control cookies through your browser settings; disabling cookies may affect the functionality of the Site. 7. Your California Privacy Rights

If you are a California resident, the CCPA provides you with the following rights with respect to your personal information, subject to certain exceptions:

Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purpose for collecting the information, and the categories of third parties with whom we share it.
Right to Delete: You may request that we delete personal information we have collected from you, subject to certain exceptions (for example, information we need to complete a transaction, comply with a legal obligation, or exercise a legal claim).
Right to Correct: You may request that we correct inaccurate personal information we maintain about you.
Right to Opt-Out of Sale or Sharing: You may direct us not to sell or share your personal information. As noted above, Pencco does not sell personal information for monetary consideration and believes it does not engage in “sharing” as defined by the CCPA in connection with cross-context behavioral advertising; if this changes, we will provide a “Do Not Sell or Share My Personal Information” link on the Site.
Right to Limit Use of Sensitive Personal Information: Because Pencco does not collect sensitive personal information from consumers in the ordinary course of operating the Site, this right is not currently applicable to our processing activities.
Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights, including by denying goods or services, charging different prices, or providing a different level of quality.
Right to Designate an Authorized Agent: You may designate an authorized agent to submit requests on your behalf. We may require proof of the agent’s authority and independent verification of your identity.

We will verify your identity before responding to a request to know or delete, generally by matching the information you provide (such as name and email address) against the information in our records. We will respond to verifiable consumer requests within the timeframes required by the CCPA, generally forty-five (45) days, subject to a possible extension of an additional forty-five (45) days when reasonably necessary.

8. Retention of Personal Information

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including to provide our products and services, comply with legal, tax, and regulatory obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and the purpose for which it was collected.

9. Minors

The Site is intended for a business and professional audience and is not directed to children under the age of sixteen (16). We do not knowingly collect personal information from children under 16. If we become aware that we have inadvertently collected personal information from a child under 16, we will take steps to delete such information.

10. Job Applicants

If you submit an application, resume, or other materials through our Careers page, the personal information you provide will be used to evaluate your candidacy and administer our recruitment process. California job applicants may have additional notice rights under the CCPA; please contact us using the information in Section 12 for more information about our applicant data practices.

11. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will post the revised Policy on this page and update the “Last Updated” date above. Your continued use of the Site following any changes constitutes acceptance of the revised Policy.
